We use the words “you” and “your” to mean you, the reader, and other visitors to our online and mobile resources who are, in all cases, over the age of 18\. Our privacy statement (“this statement,” “this privacy statement,” and “our statement”) informs you about who we are and the types of personal information we collect, how we use it, who we share it with and why, and what we do to try to protect it. WHO WE ARE

Belanger Trading LLC is an online financial news alerts and trading education company operating in the financial publishing industry. We publish market commentary, options trading education, and related content and services through belangertrading.com. For residents from the GDPR Jurisdictions, as defined below, and some US state privacy laws, Belanger Trading is the data controller responsible for your personal data. For residents of California, Belanger Trading is a “Business.”

WHO WE COLLECT PERSONAL INFORMATION FROM

We may collect personal information from the following groups of data subjects: visitors to, and users of, our online and mobile resources; our customers; current members of our workforce and those who apply for posted jobs; and third-party vendors and business partners. The categories of information we collect from each of these groups, and the ways in which we use it, differ. As you may have noticed, it’s possible that the same person could fall into more than one group. Most of this statement addresses our processing and sharing of personal information collected from visitors to and users of our online and mobile resources and our customers.

WHAT WE COLLECT

There are two types of information that we obtain from you online and then store and use: (i) non-personal information that’s collected automatically from each visitor, such as your device operating system; and (ii) personal information that you voluntarily provide to us or that is collected automatically. By using our online and mobile resources or purchasing our products or services, you are signifying to us that you agree with this section of our privacy statement and that we may use and disclose your information as described. Voluntarily Submitted Information. If you participate in certain activities via our online and mobile resources, you may be asked to provide us with information about yourself. The types of personal information we collect in those situations include identifiers (such as your name, email address, physical address, and phone number), professional information (such as the business you are in), and financial account information (such as your credit card information). We do not sell, rent, or trade voluntarily submitted personal information with third parties. If you don’t want us to collect this type of personal information, please don’t provide it. This means you shouldn’t participate in the activities on our online and mobile resources that request or require it, and you may want to communicate with us by phone or regular mail instead. Participation is strictly your choice. Not participating may limit your ability to take full advantage of the online and mobile resources, but it will not affect your ability to access certain information available to the general public on the online and mobile resources. Some of the ways you voluntarily give us your personal information and how we use it: Emails and Online Forms – When you send us an email or fill out an online form, such as to contact us, your email address and any other personal information (e.g., home address or phone number) that may be in the content of your message or attached to it, are retained by us and used to respond back directly to you and to process your request. Depending on the personal information provided, communications from us may be in the form of emails, telephone calls, and/or text messages. We may also send you information about any of our products or services we think may be of interest to you. Registering for an Account – When you register for an account, you submit personal information to us, such as your name and email address, which we then retain. We use that information to create and manage your account and, in some cases, establish a password and profile to communicate with you via email. Registering for Events – When you register for services, webinars, events, conferences, or programs we ourselves may host (rather than outsourced to a third-party event manager with its own privacy policies), you will be submitting the types of identifiers described above. If the event requires a fee, we may also ask you to submit credit card or other financial information. We use this information to register you for the event and send you communications regarding the event. Becoming a Subscriber to Our Service – We use any information provided by our customers to perform our contractual obligations and provide the products and services purchased to them, to manage their accounts, and communicate with them. Social Media and Community Features – Some of our online and mobile resources may offer social media-like community features, letting users post messages and comments, and/or upload images or other files and materials. If you choose to make use of these features, the information you post, including your screen name and any other personal information, will be in the public domain and not covered/protected by this statement. Automatically Collected Information. When you visit our online and mobile resources, basic information is passively collected through your web browser via the use of tracking technologies, such as a “cookie,” which is a small text file that is downloaded onto your computer or mobile device when you access the online and mobile resources. It allows us to recognize your computer or mobile device and store some information about your preferences or past actions. We allow third-party vendors to use cookies or similar technologies to collect information about your browsing activities over time following your use of the site. For example, we use Google Analytics, a web analytics service provided by Google, Inc. (“Google”). Google Analytics uses cookies to help us analyze how you use the online and mobile resources and enhance your experience when you visit the online and mobile resources. The internet activity information collected through cookies and other similar means includes such things as: the domain name and IP address from which you accessed our online and mobile resources; the type of browser and operating system you use; the date and time and length of your visit; the specific page visited, graphics viewed and any documents downloaded; the specific links to other sites you accessed from our online and mobile resources; and the specific links from other sites you used to access our online and mobile resources. Additionally, if you access our online and mobile resources from a phone or other mobile device, the mobile services provider may transmit to us uniquely identifiable mobile device information, which allows us to then collect mobile phone numbers and associate them with the mobile device identification information. Some mobile phone vendors also operate systems that pinpoint the physical location of devices, and we may receive this information as well if location services are enabled on your device. If you do not want us to collect and use geolocation data, disable location services through your device settings. Regardless, we use both automatically collected information and mobile device information to compile generic reports about popular pages on our online and mobile resources, and to see how our customers and followers are accessing our online and mobile resources. We then use that data to administer the online and mobile resources and make them better, make your activities more convenient and efficient, and enhance the functionality of our online and mobile resources, such as by remembering certain of your information in order to save you time. We use and retain your personal information in accordance with applicable law and as long as necessary to carry out the purposes described above in accordance with our internal data retention procedures. The following retention periods apply to the primary categories of personal information we collect: (i) customer account and subscription data is retained for the duration of the account relationship and for seven (7) years thereafter for legal and tax compliance purposes; (ii) transaction and billing records are retained for seven (7) years; (iii) email marketing contact data is retained until an opt-out or deletion request is received, after which the contact is suppressed in accordance with 16 C.F.R. § 316.5 (CAN-SPAM suppression requirements); (iv) website analytics and usage data is retained for up to twenty-four (24) months and then aggregated or deleted; and (v) SMS/text message opt-in records and consent documentation are retained for a minimum of five (5) years from the date of consent, consistent with the TCPA statute of limitations. We will also retain usage data for internal analysis purposes. Usage data is generally retained for a shorter period, except when this data is used to strengthen the security or to improve the functionality of our service, or we are legally obligated to retain this data for longer time periods.

We maintain a presence on one or more external social media platforms such as X (formerly Twitter), Facebook, Instagram, YouTube, and LinkedIn. We may further allow features of our online and mobile resources to connect with, or be viewable from, that external social media presence. Similarly, our online and mobile resources may contain links to other websites or apps controlled by third parties. We are not responsible for either the content on, or the privacy practices of, social media platforms, or any third-party sites or apps to which we link. Those apps, sites, and platforms are not controlled by us and therefore have their own privacy policies and terms of use. If you have questions about how those apps, sites, and platforms collect and use personal information, you should carefully read their privacy policies and contact them using the information they provide.

Online Tracking Technologies and Advertising

We, certain service providers operating on our behalf, and third parties may collect information about your activity, or activity on devices associated with you, on our sites and applications and third-party sites and applications using tracking technologies such as cookies, pixels, tags, software development kits, application program interfaces, and Web beacons. We may collect information whether or not you are logged in or registered, and may associate this tracking data with your registration account (if you have one). This tracking data may be used for many purposes including, for example, to: provide useful features to simplify your experience when you return to our sites and applications; deliver relevant content and advertising based on your preferences, usage patterns and location; monitor, evaluate, measure, and optimize the use and operation of our sites and applications and the advertising that you see; and analyze traffic on our sites and on the sites of third parties. We may use your personal information to deliver relevant marketing and advertising to you on our properties and on third parties’ sites and applications. We may provide social media and other platforms with limited personal information, such as certain identifiers or your hashed email address, which they match with their customers’ profiles. Based on this, the platform may show you our ads, look for other users who may enjoy our ads, suppress our ads for you, and provide us with insights on how to optimize and better target our advertising. Some states provide residents or, in some cases, their authorized agents, with the right to opt out of the “selling” or “sharing” of their “personal information”, or of “targeted advertising” based on their “personal information.” To submit a request to opt out you may visit our “Do Not Sell or Share My Personal Information” and “Targeted Advertising” Opt Out Rights page. Please note that your opt-out choice is specific to the digital property and to the device and browser you are using. If you access other digital properties of Belanger Trading, you will need to make a separate election for each. Also, if you clear your cookies on your browser or use another browser or device, you may need to opt out again. You may also choose to opt out of targeted advertising directly with many ad networks and partners, data exchanges, marketing analytics, and other digital advertising and marketing service providers. We adhere to the Digital Advertising Alliance’s Self-Regulatory Principles for Online Behavioral Advertising. Online Tracking Technologies – Examples include: Cookies. Cookies are pieces of information that a website places on the hard drive of your computer when you visit the website. Cookies may involve the transmission of information from us to you and from you directly to us, to another party on our behalf, or to another party in accordance with its privacy policy. You can choose to have your computer warn you each time a cookie is being placed on your device, or you can choose to block all cookies. You do this through your browser settings. If you turn cookies off, some of our services will not function properly. Web beacons and marketing pixels. Web beacons and marketing pixels are small pieces of data that are embedded in images on the pages of sites. They may involve the transmission of information directly to us, to another party on our behalf, or to another party in accordance with its privacy policy. Opt Out Preference Signals and Do Not Track – You or your authorized agent may choose to enable online, where available, a universal tool that automatically communicates your opt-out preferences, such as the Global Privacy Control (“GPC”). We will process the GPC signal as a request to opt out of the sale or sharing of your personal information and targeted advertising, as required under applicable state law, including Cal. Civ. Code § 1798.135(b) and the Texas Data Privacy and Security Act (Tex. Bus. & Com. Code Ch. 541).

HOW WE USE YOUR INFORMATION

Belanger Trading may use the information we collect from and about you for a variety of business purposes; in general, to provide the services, improve customer experience and engagement, and develop the services. We are committed to protecting and maintaining the privacy of your information. Therefore, we will process your data only in accordance with applicable data protection law and this Privacy Statement. We will have a lawful basis for processing your data if: we need to process your information in order to provide you with the products or service you have requested or to enter into a contract; you have consented to such processing; we have a legitimate interest for processing your data (e.g., for fraud prevention; direct marketing; network and information systems security; data analytics; enhancing, modifying or improving our services; identifying usage trends; determining the effectiveness of promotional campaigns; and advertising personalization); and/or we are legally obliged to process it. We may use any and all information that we collect from you for the following purposes: to provide the requested services; to manage your account; to personalize your experience; to improve our website and services; to diagnose technical problems; to process transactions; to administer contests, promotions, or surveys; to develop new products or services; to send periodic service communications; to protect security and prevent fraud; to send you marketing and promotional emails; and to target prospective customers with our services where permitted by applicable law.

WHEN/WITH WHOM DO WE SHARE PERSONAL INFORMATION

We use voluntarily provided personal information to respond to your inquiries and to provide the services you have requested. We do not sell or rent your personal information to third-party data vendors or marketing companies. We disclose your information when required by law. Affiliates. We may share your information within our family of companies, which will use such information in generally the same manner as described in this privacy statement. Legally Compelled Disclosures. We may disclose your information to government authorities or other third parties when compelled to do so by law, including but not limited to responding to court orders and subpoenas. To Prevent Harm. We may disclose your information when we have reason to believe that someone is causing injury to, or interfering with, our rights or property, other users, or anyone else who could be harmed. Business Transfer. If we or any of our affiliates, or substantially all of our assets, are acquired by one or more third parties as a result of an acquisition, merger, sale, reorganization, consolidation, or liquidation, personal information may be one of the transferred assets. Vendors and Business Partners. We may share your information with vendors and other third parties with whom we have a contractual relationship, only to the extent necessary to carry out the applicable business purpose. We attempt to bind such vendors and business partners to appropriate data protection standards via written contracts.

EMAIL COMMUNICATIONS, NEWSLETTERS, AND MARKETING

We may use your personal data to contact you with newsletters, marketing or promotional materials, and other information that may be of interest to you. You may opt out of receiving any, or all, of these communications from us by following the unsubscribe link or instructions provided in any email we send, or by contacting us at support@belangertrading.com. We may use email marketing service providers to manage and send emails to you.

TEXTING / SMS / MMS

By joining our text list, you consent to receive SMS/MMS texts about our products and services at the number provided, from Belanger Trading LLC only. Consent to receive text messages is not a condition of purchase of any product or service. Message frequency varies. You may revoke your consent at any time by replying STOP, QUIT, END, CANCEL, REVOKE, OPT OUT, or UNSUBSCRIBE, or by emailing us at support@belangertrading.com. We will honor all revocation requests within ten (10) business days. Reply HELP for help. Message & Data Rates may apply. No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

PAYMENTS

We may provide paid products and/or services within the Service. In that case, we may use third-party services for payment processing. We will not store or collect your payment card details. That information is provided directly to our third-party payment processors, whose use of your personal information is governed by their Privacy Policy. These payment processors adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council.

YOUR RIGHTS AND OPTIONS

You may have to provide personal information to enjoy most of the features of our online and mobile resources. Moreover, you can opt out of certain activities like newsletters and announcements. Residents of California, Virginia, Texas, and other states, as well as EU data subjects, have certain additional rights as described in the sections below. When you access your account on the Services, you have the option to change certain information about yourself, such as your billing or shipping address and telephone number. Emails. If you consented to receive direct marketing from Belanger Trading, we provide you with the opportunity to opt out of our marketing communications or change your preferences by following a link in the footer of all non-transactional email messages from us or by emailing us at support@belangertrading.com. Transactional or service communications (for example, account notifications and billing information) are not subject to opt-out.

THE CALIFORNIA CONSUMER PRIVACY ACT

When we collect personal information from California residents, we become subject to, and those residents have rights under, the California Consumer Privacy Act and the California Privacy Rights Act (together, the “CCPA”). For purposes of this section, the words “you” and “your” mean only California residents. What We Collect from California Residents: We collect identifiers (name, address, IP address); personal information described in Cal. Civ. Code § 1798.80(e) (name, address, telephone number, credit card number); commercial information (products or services purchased); internet/electronic activity (browsing and search history); geolocation data; and audio, video, electronic or similar information. Rights of California Residents: Access: You may request that we disclose to you (1) the categories and specific pieces of personal information we have collected from you; (2) the sources of that personal information; (3) the business or commercial purpose for collection; (4) the categories of personal information disclosed for a commercial purpose; and (5) the categories of third parties with whom we have shared your personal information. You may submit an access request at any time, subject to our identity verification process. Deletion: You may request that we delete personal information we have collected from or about you (Cal. Civ. Code § 1798.105). Upon receiving a verified request, we will delete your personal information from our records and direct our service providers and contractors to delete your personal information from their records, subject to certain exceptions permitted by law (such as retaining information necessary to complete a transaction you requested, to detect security incidents, or to comply with a legal obligation). Opt-Out of Sale or Sharing: You have the right to opt out of the “sale” or “sharing” of your personal information as those terms are defined under the CCPA and CPRA (Cal. Civ. Code §§ 1798.100, 1798.120). “Sharing” includes disclosing personal information to third parties for cross-context behavioral advertising. To submit a request to opt out, please see the “Opt Out Form” section of this policy or visit our “Do Not Sell or Share My Personal Information” page on our website. Note: Minors under 16 years of age have the right to opt in (rather than opt out) before their personal information may be sold or shared. You may request that we correct inaccurate personal information we hold about you (Cal. Civ. Code § 1798.106). Upon receiving a verified request, we will use commercially reasonable efforts to correct the inaccuracy. Limit Use of Sensitive Personal Information: You may request that we limit our use and disclosure of your sensitive personal information (including precise geolocation data) to purposes necessary to perform the services you requested, as provided under Cal. Civ. Code § 1798.121. Non-Discrimination: If you exercise these rights, we will not discriminate against you by treating you differently from other California residents who did not exercise their rights. California “Shine the Light” Law: Separately from the CCPA, California Civil Code § 1798.83 (the “Shine the Light” law) permits California residents to request, once per year, information about personal information disclosed to third parties for their direct marketing purposes during the prior calendar year. We may ask you to complete a verification process. We will confirm receipt and respond within the time frames prescribed by the CCPA (generally 45 days, extendable by an additional 45 days upon notice).

VIRGINIA RESIDENTS

If you are a Virginia resident, you may take advantage of certain privacy rights pursuant to the Virginia Consumer Data Protection Act (Va. Code § 59.1-571 et seq.). You may request to: (1) confirm whether we are processing your personal data and access it; (2) correct inaccurate personal data (Va. Code § 59.1-577(A)(2)); (3) delete personal data provided by or obtained about you; (4) obtain a copy of your personal data in a portable and readily usable format (Va. Code § 59.1-577(A)(4)); (5) opt out of the sale of personal data, targeted advertising, and profiling in furtherance of decisions that produce legal or similarly significant effects. Appeal Process: If we deny your privacy rights request, you may appeal our decision by submitting a written appeal to support@belangertrading.com within thirty (30) days of receiving our response. We will respond to your appeal within sixty (60) days. If your appeal is denied, you may contact the Virginia Attorney General at https://www.oag.state.va.us to submit a complaint (Va. Code § 59.1-577(C)). To exercise your rights, contact us at support@belangertrading.com. We may ask you to fill out a request form and verify your identity. We will confirm receipt and respond within the time frames prescribed by Virginia law (generally 45 days, extendable by an additional 45 days).

TEXAS RESIDENTS

If you are a Texas resident, you may have rights under the Texas Data Privacy and Security Act (Tex. Bus. & Com. Code Ch. 541\) (“TDPSA”), effective July 1, 2024\. Texas residents may have the right to: (1) confirm whether we are processing your personal data and access it; (2) correct inaccuracies in your personal data; (3) delete personal data provided by or obtained about you; (4) obtain a copy of your personal data in a portable and readily usable format; and (5) opt out of the processing of your personal data for purposes of targeted advertising, the sale of personal data, or profiling in furtherance of decisions that produce legal or similarly significant effects. To submit a request, you may: (a) email us at support@belangertrading.com; or (b) submit a request through the privacy request form available at https://belangertrading.com/privacy-request. We will respond within 45 days of receiving a verifiable request, with a possible 45-day extension for complex requests upon written notice. Appeal: If we deny your request, you may appeal by emailing support@belangertrading.com with the subject line “Texas Privacy Appeal” within thirty (30) days of our decision. We will respond within 60 days. If your appeal is denied, you may contact the Texas Attorney General at https://www.texasattorneygeneral.gov.

THE EU GENERAL DATA PROTECTION REGULATION

We do collect or otherwise obtain personal information from data subjects located in the GDPR Jurisdictions. We describe below how we comply with the GDPR for personal information collected from visitors to and users of our online and mobile resources while they were in a GDPR Jurisdiction. For purposes of this section, the words “you” and “your” mean only such visitors and users. What do we collect from you and how do we use it? We collect from you the categories of personal information already described. The lawful basis on which we rely depends on the nature of the processing activity: (a) where processing is necessary to perform a contract with you or to take steps at your request prior to entering a contract, we rely on Article 6(1)(b) (contract performance); (b) where you have provided explicit consent, we rely on Article 6(1)(a) (consent), including for direct marketing communications to EU/EEA-based prospects; and (c) for analytics, security, fraud prevention, and service improvement, we rely on Article 6(1)(f) (legitimate interests), having determined that our interests are not overridden by your rights and freedoms. As stated elsewhere in this statement, we do not sell any of your personal information to third parties, nor do we use it for automated decision-making. Cross-border Data Transfers and Third-Party Processors: If we transfer personal information from the GDPR Jurisdictions to a location that has not been deemed by the European Commission to have adequate privacy protections, we do so in the manner the GDPR permits. Where required, we rely on the European Commission’s Standard Contractual Clauses (“SCCs”) as the transfer mechanism for personal data transferred from the European Economic Area, the United Kingdom, or Switzerland to the United States or other third countries. You may request a copy of the applicable SCCs by contacting us at support@belangertrading.com. Rights of Data Subjects in the GDPR Jurisdictions: With respect to personal information collected from you while you were in a GDPR Jurisdiction, you have the rights of: transparency, access, correction and deletion, portability, restriction/objection, and the right to lodge a complaint with your data protection regulator. To exercise any of these rights, please contact support@belangertrading.com. GDPR Jurisdictions means the countries composed of the European Economic Area (including Iceland, Liechtenstein, and Norway) and the EU member states. Additionally, certain countries have received an adequacy decision from the European Commission. The United Kingdom is governed by the UK General Data Protection Regulation (“UK-GDPR”) and is no longer subject to the EU GDPR.

RIGHTS OF DATA SUBJECTS IN OTHER JURISDICTIONS

In other jurisdictions with similar data privacy regulations, we may collect from you the categories of personal information already described. We collect and manage (including disclose) such data in compliance with applicable local law(s). We do not sell any of your personal information to third parties, nor do we use it for automated decision-making. Additional U.S. State Privacy Rights. Residents of states with comprehensive consumer privacy laws—including but not limited to Colorado, Connecticut, Oregon, and Montana—may have rights substantially similar to those described in the Virginia section above, including the rights to: (1) confirm whether we process your personal data and access it; (2) correct inaccuracies; (3) delete personal data; (4) obtain a copy in a portable format; and (5) opt out of the processing of personal data for purposes of targeted advertising, sale, or profiling in furtherance of decisions that produce legal or similarly significant effects. To exercise any of these rights, please contact us at support@belangertrading.com. We will respond within the time period required by your state’s law. If we deny your request, you may appeal by contacting us at support@belangertrading.com with the subject line “[State] Privacy Appeal” and, if your appeal is denied, by contacting your state’s Attorney General.

CHILDREN’S PRIVACY

Federal law imposes special restrictions and obligations on commercial website operators who direct their operations toward, and collect and use information from, children under the age of 18\. We take those age-related requirements very seriously. Consistent with those requirements, our online and mobile resources are not intended for use by anyone under the age of 18\. If we become aware that anyone under the age of 18 has submitted personal information to our online and mobile resources, we will delete that information and will not use it for any purpose whatsoever. If you believe that someone under the age of 18 has submitted personal information to our online and mobile resources, please contact us at support@belangertrading.com.

HOW WE PROTECT COLLECTED PERSONAL INFORMATION

We will take all reasonable security precautions to protect your personal information provided to our online and mobile resources. We have adopted a security program that includes technical, organizational, administrative, and other security measures designed to protect, in a manner consistent with accepted industry standards and applicable law, against anticipated or actual threats to the security of personal information (the “Security Program”). We cannot, however, guarantee that your information will be free from unauthorized access or that loss, misuse, destruction, or alteration will not occur. Nonetheless, we have specific incident response and management procedures that are activated whenever we become aware that your personal information was likely to have been compromised. We further require, as part of our vendor and business partner oversight procedures, that such parties notify us immediately if they have any reason to believe that an incident adversely affecting personal information we provided to them has occurred.

OPT OUT FORM

Some states provide residents with the right to opt out of the “selling” or “sharing” of their personal information, or of “targeted advertising.” To submit a request to opt out of the sale or sharing of your personal information or of targeted advertising, you may: (a) email support@belangertrading.com with the subject line “Do Not Sell or Share My Personal Information”; or (b) submit a request through the privacy request form available at https://belangertrading.com/privacy-request. By submitting a request, you will be exercising your Do Not Sell or Share My Personal Information right and/or your right to opt out of targeted advertising. Please include your first name, last name, email address, country, and state in your request so that we can process and verify it.

AGENT AUTHORIZATION

You may authorize someone to make a privacy rights request on your behalf (an authorized agent). Authorized agents need to demonstrate that you’ve authorized them to act on your behalf or must demonstrate they have power of attorney pursuant to applicable probate law. Belanger Trading retains the right to request confirmation directly from you confirming that the agent is authorized to make such a request, or to request additional information to confirm the agent’s identity. An authorized agent is prohibited from using a consumer’s personal information, or any information collected from or about the consumer, for any purpose other than to fulfill the consumer’s requests, for verification, or for fraud prevention.
